Definition of Violation Of Order Of Protection. In Illinois, a person commits a violation of an order of protection when, having been served notice of the contents of an order of protection or otherwise having actual knowledge of the contents of the order, he [(commits an act which was prohibited by a court) (fails to commit an act which was ordered by a court)] in an order of protection. 11.77 - Illinois Pattern Jury Instructions - Criminal 4th Edition
Issues In Violation Of Order Of Protection - To sustain the charge of violation of an order of protection, the State must prove the following propositions: First Proposition: That the defendant __________________; and Second Proposition: That an order of protection prohibited the defendant from committing [(that act) (those acts)]; or Second Proposition: That an order of protection prohibited the defendant from committing [(that act) (those acts)]; and Third Proposition: That the order of protection was in effect at the time the defendant _____________; and Fourth Proposition: That at the time the defendant ________________, he had been served notice of the contents of an order of protection or otherwise had actual knowledge of the contents of the order. 11.78 - Illinois Pattern Jury instructions - Criminal 4th Edition In order for the defendant to be found guilty of the offense of violation of order of protection, the State must prove each of the propositions beyond a reasonable doubt.
Sentencing - Violation of an order of protection is a Class A misdemeanor; however, depending on the defendant’s prior criminal history the charge could be enhanced to a felony offense. 720 ILCS 5/12-30
