Residential Burglary

Definition of Residential Burglary. In Illinois, a person commits residential burglary who knowingly and without authority enters or knowingly and without authority remains within the dwelling place of another, or any part thereof, with the intent to commit therein a felony or theft. This offense includes the offense of burglary as defined in 720 ILCS 19-1.

Issues In Residential Burglary - To sustain the charge of residentila burglary, the state must prove the following propositions: First Proposition: That the defendant knowingly entered the dwelling place of another; and Second Proposition: That the defendant did so without authority; and Third Proposition: That the defendant did so with the intent to commit therin the offense of _________________ (theft or a felony). 14.14 - Illinois Pattern Jury Instructions - Criminal 4th Edition

Sentencing - Residential burglary is a non-probational (”except as otherwise provided in 40-10 of the Alcoholism and Other Drug Abuse and Dependency Act” (20 ILCS 301/40-10(a)) Class 1 felony punishable by between 4 to 15 years in the Illinois Department of Corrections. If the defendant is eligible for extened term, he could be sentenced between 15 to 30 years in the Illinois Department of Corrections.
