Definition of Prostitution. In Illinois, a person commits the offense of prostitution when [(he) (she)] [(intentionally) (knowingly)] [(performs) (offers to perform) (agrees to perform)] [(any act of sexual penetration) (any touching or fondling of the sex organs of one person by another for the purpose of sexual arousal or gratification)] for any money, property, token, object, or article or anything of value. - 9.09 - Illinois Pattern Jury Instructions-Criminal 4th Edition.
Sentencing - Prostition is a Class A misdemeanor or depending on one’s prior criminal history the offense could be a Class 4 felony. Also, a person who violates this section within 1,000 feet of real property comprising a school commits a Class 4 felony. 720 ILCS 5/11-14.
