Definition of Kidnapping. In Illinois, (a) Kidnaping occurs when a person knowingly: (1) And secretly confines another against his will, or (2) By force or threat of immediate force carries another from one place to another with intent secretly to confine him against his will, or (3) By deceit or enticement induces in other to go from one place to another with intent secretly to confine him against his will. (b) Confinement of a child under the age of 13 year is against his will within the meaning of this Section if such confinement is without the consent of his parent or legal legal guardian. 720 ILCS 5/10-1.
Sentencing - Kidnapping is a Class 2 felony punishable with a prison term of between 3 to 7 years in the Illinois Department of Corrections, a fine up to $25,000, a 2 year tem of mandatory supervised release after prison and/or up to 4 years of probation or conditional discharge. If a defendant is extended term eligible, he could be sentence to a prison term of between 7 to 14 years in the Illinois Department of Corrections.
