Definition of Domestic Battery. In Illinois, a person commits the offense of domestic battery when he [ (intentionally) (knowingly) ] [without legal justification] and by any means [ (causes bodily harm to) (makes physical contact of an insulting or provoking nature with)] any family or household member. 11.11- Illinois Pattern Jury Instructions - Criminal 4th Edition
Sentencing - Domestic battery, 720 ILCS 5/12-3.2., is a Class A misdemeanor or a Class 4 felony depending on one’s prior convictions. A Class A misdemeanor is punishable by up to 364 days in the county jail, up to a $2,500 fine and/or up to 2 years of probation or conditional discharge. A Class 4 felony is punishable by a prison term of between 1 to 3 years in the Illinois Department of Corrections, up to a $25,000 fine, a 1 year term of mandatory supervised release and/or up to 30 months of probation or conditional discharge. If a defendant is eligible for extended term, he could be sentence to a prison term of between 3 to 6 years in the Illinois Department of Corrections.
