Assault

Definition of Assault.  In Illinois, a person commits assault when, without lawful authority, he engages in conduct which places another in reasonable apprehension of receiving a battery.  720 ILCS 5/12-1

Issues in Assault - To sustain the charge of assault, the State must prove the following proposition: That the defendant [ (knowingly) (intentionally) ] engaged in conduct which placed ______________ in reasonable apprehension of receiving [ (bodily harm) (physical contact of an insulting or provoking nature) ].  The State must prove this proposition beyond a reasonable doubt before the defendant can be found guilty.  11.02 Illinois Pattern Jury Instructions - Criminal 4th Edition

Sentencing - Assault is a Class C misdemeanor punishable by up to 30 days in the county jail, a fine of up to $1,500 and/or up to 2 years of probation or conditional discharge. 

Community Service - In addition to any other sentence that may be imposed, a court shall order any person convicted of assault to perform community service for not less than 30 and not more than 120 hours, if community service is available in the jurisdiction and is funded and approved by the county board of the county where the offense was committed.  In addition, whenever any person is placed on supervision for an alleged offense of assault, the supervision shall be conditioned upon the performance of the community service.
